Terms of Service

§ 1 Scope

These Terms of Service (TOS) apply to the use of the platform myDroid.chat, operated by VividDroid Studio UG (haftungsbeschränkt) (hereinafter "Provider"). By registering or using the platform, the user agrees to these TOS.

§ 2 Service Description

myDroid.chat is an AI companion platform that provides the following services:

• Conversation with Droids via text chat
• Creating and customizing your own Droids
• Interactive story experiences in game master mode
• Optional AI image generation (credits-based)
• Optional AI voice output (credits-based)
• Droid marketplace for sharing your own Droids

The provider currently operates myDroid.chat as a public beta. The service is provided without any guarantee of permanent availability.

§ 3 Registration & Account

(1) Registration and login are exclusively via linked third-party accounts (Google or Apple). A separate password registration is not provided. Only one account per person is allowed.

(2) The user is responsible for the security of their linked third-party account themselves. Suspicious activities must be reported to the provider immediately.

(3) The provider reserves the right to block or delete accounts for violations of these TOS or the Acceptable Use Policy.

§ 4 Age Verification & Content Rating

(1) The platform requires a minimum age of 16 years. Three content rating levels apply:

• SFW (Safe for Work) – Age-appropriate content without romantic or explicit elements. Suitable for all users aged 16 and above.
• Mature – Content with darker themes, mild romance, and implied intimacy between adult fictional characters. Accessible from age 16. SFW and Mature are the default access level for all users aged 16 and above.
• Explicit – Explicit content exclusively between adult fictional characters. Only accessible to users aged 18 and above, and requires the user to actively enable it in their profile settings.

(2) Users between 16 and 17 years of age do not have access to Explicit content. Users aged 18 and above may unlock Explicit content in their profile settings.

(3) The user confirms their age truthfully upon registration. False age information constitutes a violation of these TOS and may lead to account suspension. Further details: Youth Protection Information.

§ 5 Usage Rights, Ownership & AI Labeling Obligation

(1) Self-created Droids and story templates remain the intellectual property of the user. The user grants the provider a non-exclusive, free right of use to provide the service.

(2) By publishing a Droid or a story in the marketplace, the user grants other platform users the right to non-commercial use.

(3) AI-generated content (chat responses, images, audio files) are, according to current German and European law, not subject to original copyright protection of the user. The user nevertheless receives a comprehensive right of use to the content generated by them for private and non-commercial purposes.

(4) Responsibility for distribution. The user is solely responsible for the distribution of AI-generated content on external platforms (e.g., social media, websites, publications). The provider assumes no liability for consequences arising from the public distribution of this content by the user.

(5) Labeling obligation according to EU AI Act (Art. 50 AI-VO). Since August 2, 2026, the EU AI Act requires users to label synthetic content (especially images, audio, and video) created with AI systems as AI-generated when sharing it in public. This applies in particular to:

• AI-generated images shared on social media platforms
• AI-generated voice recordings or audio content
• AI-generated texts that are presented as written by a human
• Synthetic media (deepfakes) that show real people

Common formats for labeling include the notice "AI-generated" / "KI-generiert", the hashtag #AIGenerated or platform-specific AI labeling functions (e.g., at Meta, TikTok, YouTube). Many platforms also require such a label in their own terms of use.

(6) The user indemnifies the provider from all claims of third parties arising from a culpable failure to label or any other illegal use of AI-generated content by the user.

§ 6 User Obligations

The user undertakes to comply with the Acceptable Use Policy (AUP) and not to create or distribute any illegal, offensive, or third-party rights infringing content.

In particular, the following are prohibited: sexual depictions of minors (CSAM), the distribution of illegal content, the use of the platform for manipulation or deception of real people, and automated scraping or misuse of the API.

§ 7 Credits

(1) Certain functions (image generation, voice output) require credits. Credits are consumed by using these functions.

(2) Since myDroid.chat is in the beta phase, credits are currently provided free of charge. Future changes to the billing model will be announced in a timely manner.

(3) Credits do not expire and cannot be transferred between users, unless otherwise stated.

§ 8 Liability of the Provider

(1) The provider is liable without limitation for damages resulting from injury to life, body or health, as well as for intentional or grossly negligent breaches of duty.

(2) In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the contract-typical, foreseeable damage.

(3) AI-generated content can be factually incorrect, incomplete or misleading. The provider assumes no liability for the accuracy of AI-generated output. Use for medical, legal or financial decisions without expert review is expressly not recommended.

§ 9 Changes to the TOS

The provider reserves the right to change these TOS with reasonable notice (at least 30 days before entry into force). Changes will be communicated by e-mail and by a notice on the platform. Continued use after entry into force is deemed to be consent.

§ 10 Termination & Account Deletion

(1) The user can delete their account at any time via their user profile (profile page → "Delete account"). All personal data, chat logs and uploaded content will be irrevocably deleted.

(2) The provider may block or delete accounts in the event of serious or repeated violations of these TOS without prior notice.

(3) Accounts that have not been used for more than 24 months (no login, no activity) are considered inactive and will be automatically deleted by the provider after prior e-mail notification to the stored address. All stored data, chat logs and content will be irrevocably removed. The notification will be sent at least 30 days before the planned deletion.

§ 11 Data Protection

Information on the processing of personal data can be found in the Privacy Policy.

§ 12 Final Provisions

(1) The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction for all disputes arising from this contractual relationship is, if the user is a merchant or has no general place of jurisdiction in Germany, the registered office of the provider.

(3) Should individual provisions of these TOS be ineffective, the effectiveness of the remaining provisions shall remain unaffected.
